Here you will learn about the vape laws in Spain in 2026. Generally, vape laws in Spain are as per the overarching TPD rules except in the following areas. All EU markets are required to notify vape products but some market are not required to notify nicotine-free products (see section below).

Spain vape regulation is laid down in Royal Decree 579/2017 transposed from EU Tobacco Products Directive 2014/40/EU.
The Ministry of Health (specifically the Dirección General de Salud Pública) is the primary body for TPD compliance and notifications via EU-CEG.
Cross-border sales of nicotine-containing vapes in Spain are not permitted.
Retailers in Spain are not required to register before selling vapes.
There are no specific lab testing requirements.

Reportedly, disposable vapes are likely to be banned in Spain in the near future.
Proposed changes to the vape laws in Spain mean fruit flavours could be banned in the future.
In Spain, nicotine-free vape products are required to be notified via the EU TPD portal.

The Ministry of Health maintains and periodically updates a positive list (Lista de productos notificados) on their official website. This list allows retailers and consumers to verify that a product has been legally submitted through the EU-CEG portal.
